Fired for being irresistable to the boss

Last week, Iowa’s all-male high court upheld the legality of terminating a female employee because her boss found her too attractive. Iowa dentist James Knight fired his assistant, Melissa Nelson, after a decade-long tenure because he found her “irresistible” and said he would be likely to have an affair with her if he kept her on the payroll, according to the court’s opinion.

In 2009, Knight’s wife Jeanne demanded that her husband fire his 32-year-old assistant Melissa Nelson after she found out the two sometimes exchanged text messages, according to court documents.

Okay so the ad for a new assistant will read like this. If your attractive do not apply, only unattractive people will be accepted and my wife will be screening all applicants. If you meet with her approval you will be hired.

Isn't that discrimination?

The dentist needed to realize he was a doorknob and get counselling to deal with his issues (not able to contain his comments, nor redirect his focus or acknowledge that he was unprofessional). Not only did his conduct cross employment law boundaries, it is very possible his conduct (comments, texting) would be seen as unprofessional in dentistry by his regulatory group.

The dentist's wife had a reasonable request to demand an end to the texting as it is seen as a form of emotional straying in marriage. However, to ask that her spouse terminate the assistant--wow, overboard much in this economy?

Just how much knowledge of employment laws did the dentist have prior to his attention being absorbed in his assistant's looks? Refresher courses seem necessary here.
