Canada - Legal Marijuana

Postby deja vu on Tue Oct 16, 2018 8:35 pm

Lots of information and articles on the subject. In less than 6 hours it will be legal in Canada, but not the edibles. That issue is at least 1 year away from being legal.

Here are some links on the issues surrounding this new law.

.

I guess I wasn't paying attention as I spotted the headlines over the past months that indicated this law was going to be enacted, because I only just realized that this is not a law related to using the cannabis for medical purposes.

I guess a BBC article would be best here:

Canada becomes second country to legalise recreational marijuana

And some of the opening lines are:

The first recreational cannabis to be legally bought in Canada was purchased at midnight on Wednesday (02:30 GMT) on the eastern island of Newfoundland amid queues of hundreds of people.

Canada has become the second country after Uruguay to legalise possession and use of recreational cannabis.

Medical marijuana has been legal in the country since 2001.

But concerns remain, including about the readiness for police forces to tackle drug impaired driving.

Information has been sent to 15m households about the new laws and there are public awareness campaigns.

Of course, I must also confess that I didn't know that it had been legal for medical purposes for so many years. It's just not something I ever really cared about. That is, until I just read it was now a recreational thing in Canada. That does surprise me, for some reason.

Lots of red tape to go through to get the medical card to be allowed to smoke it. A survey now says just over 60% of Canadians are not interested in using it, but they expect that number may go up when it comes to medical. Some that did not apply for the card, or are waiting for one may now try it to help with the pain they feel.

To add to the discussion, persons living in rental housing can face landlords who can prohibit use or growth of marijuana in their buildings. So one might not be able to legally use the marijuana indoors.

One of the regional police forces in Ontario put together a Frequently Asked Questions webpage together and shared it on Twitter:

I believe that I have read that there were some sort of retail outlets (stores, if you wish) that were open for selling this marijuana stuff within minutes of a certain time when this new law went into effect.

I'm a little bit confused about that information.

Before that law went into effect wasn't the shipping of this marijuana stuff illegal?

If the answer to the question above it 'Yes.' then only two possibilities exist:

1. Another law was in effect that allowed the shipping of this stuff.

2. Law enforcement was told to look the other way.

Number two is a kick in the butt to all sorts of matters related to the law of the land in Canada. By extension, it would be a kick in the butt to civil law all over Earth. Maybe even criminal law. (Actually, I am not even sure if both civil law and criminal law are on the same bus in that situation. I'm not a lawyer.)

Does anyone know if it was number two?

It varies between the provinces and territories. In BC only one government store is open and any private had to close while they go through the process to get their license. Ontario I think is through the government liquor board and make a drug store chain.

Yes it was illegal to ship it until 12:01am that day.

The law to ship was part of the law that it became legal on. Right now most if not all law enforcement are not cracking down on the stores opening while waiting for their licence, but are cracking down on smoking where not allowed and driving offences.

Since medical marijuana was legal for about two years, there were licenced marijuana providers working for the Cdn govt to supply marijuana to permit holders. I'm sure there had to be a shipping method allowed or how else would the processed product reach the people needing it?

One would think that shipping had to be regulated in some way to make it legal. But then again, we're dealing with the government here. haha

I've known about South Korea and its stance on how its laws affects its citizens even if the activities they do abroad contravene South Korean laws i.e. using marijuana. Add Japan and China to the list of countries expecting citizens to obey its drug laws even in Canada.
The Chinese statement, posted on the consulate’s website, included a long explanation of the Canadian and provincial laws, advising them to read it carefully to avoid running afoul of the new regulations.

Both Japan and South Korea warned their citizens in Canada ahead of the legalization.

The Japanese consulate in Vancouver warned on its website that Japanese laws outlawing the possession and sale of marijuana may be applied to actions taken abroad.

Recent days of news has indicated that some Canadian stores have closed (voluntarily or due to police closures) and there are stores that have run out of product. The rotating postal strikes in Canada layer in another factor to slow deliveries of marijuana to customers.
